Refund Policy

1. Service Commencement. All services provided by NexaFusionWorks are digital deliverables. Once a project has commenced and initial deliverables have been provided, refund eligibility is assessed based on the project milestone stage at the time of the refund request.

2. Pre-Commencement Cancellation. If you cancel a project before any work has commenced, you are entitled to a full refund of any advance payment. Requests must be submitted in writing to [email protected].

3. Partial Refunds. If a project is cancelled after work has commenced but before completion, a partial refund may be issued proportional to the undelivered portion of the agreed scope. Refund calculations are based on documented project milestones and time logs maintained by NexaFusionWorks.

4. Completed Deliverables. No refund will be issued for services that have been fully delivered and accepted. Acceptance is presumed 7 days after delivery unless a written objection is received within that period.

5. Defective Deliverables. If deliverables do not conform to the agreed specifications, NexaFusionWorks will, at its option, remedy the defect or issue a refund for the non-conforming portion. Defect claims must be submitted within 14 days of delivery with specific documentation of the non-conformity.

6. Refund Processing. Approved refunds will be processed within 14 business days using the original payment method. NexaFusionWorks reserves the right to deduct reasonable administrative costs from refunds where applicable under Spanish consumer protection law.

Section 04

Terms of Service

1. Acceptance. By accessing and using the services of NexaFusionWorks (Calle General Millán Astray 22, 2 B, Madrid, Spain), you agree to be bound by these Terms of Service. If you do not agree, you must not use our services.

2. Scope of Services. NexaFusionWorks provides digital design, typography, UI component engineering, and layout services. The specific scope, deliverables, timeline, and pricing for each project are defined in a separate written agreement or proposal accepted by both parties.

3. Intellectual Property. Upon full payment, all intellectual property rights in the final deliverables are transferred to the client. NexaFusionWorks retains the right to display completed work in portfolio and marketing materials unless otherwise agreed in writing. Pre-existing tools, libraries, and methodologies remain the property of NexaFusionWorks.

4. Payment Terms. Payments are due as specified in the project agreement. Late payments may incur interest at the rate established by Spanish commercial law. NexaFusionWorks reserves the right to suspend work if payments are overdue by more than 15 days.

5. Client Obligations. The client is responsible for providing timely feedback, approvals, and necessary materials. Delays in client response exceeding 14 business days may result in project timeline adjustments. NexaFusionWorks is not liable for delays caused by incomplete or late client inputs.

6. Limitation of Liability. NexaFusionWorks' total liability under any agreement shall not exceed the total fees paid by the client for the specific project giving rise to the claim. NexaFusionWorks shall not be liable for indirect, consequential, or incidental damages.

7. Confidentiality. Both parties agree to maintain the confidentiality of proprietary information shared during the course of the engagement. This obligation survives termination of the agreement for a period of 2 years.

8. Termination. Either party may terminate a project agreement with 14 days written notice. In the event of termination, the client shall pay for all work completed up to the termination date. NexaFusionWorks shall deliver all completed work product upon receipt of final payment.

9. Governing Law. These terms are governed by the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain.
